1. Agreement
These Terms of Service ("Terms") form a contract between MEKKAN AI LTD, a company registered in England & Wales under company number 16763924 with registered office at 167–169 Great Portland Street, London W1W 5PF ("Mekkan", "we", "us"), and the person or business that signs up for a Mekkan account ("you", "Studio").
By creating an account, signing in, or using any part of the Service, you accept these Terms. If you do not accept them, do not use the Service.
If you are signing up on behalf of a business, you confirm you have authority to bind that business to these Terms.
2. Definitions
"Service" means the Mekkan platform, including the dashboard, the booking system, Leon (our AI agent for chat, voice, and email), forecasting, reporting, and any related software or services we provide.
"Subscription" means the Mekkan plan and any optional add-ons (such as Talk to Leon, the AI Receptionist or Client Loyalty) you select on the pricing page.
"Studio Customer" means an end-customer of yours whose data passes through the Service (e.g. someone booking an appointment with your studio).
"Studio Data" means data about your business, your staff, your bookings, and your Studio Customers that you provide to the Service or that the Service generates while serving you.
3. Your account
You must be at least 18 years old and legally able to enter into a contract to use the Service.
You are responsible for keeping your password and access credentials secure. Notify us at support@mekkan.ai immediately if you suspect unauthorised access.
You are responsible for everything done through your account, including by staff you grant access to. Configure roles and permissions appropriately.
You must provide accurate registration information and keep it up to date.
4. The Service, and how AI fits in
Mekkan provides software to help appointment-driven businesses run more smoothly. This includes booking, scheduling, analytics, forecasting, and an AI agent called Leon that can answer calls, chats, and emails on your behalf.
Leon is built on large language models and speech models provided by third parties (currently Anthropic and ElevenLabs). AI outputs can be wrong, mistimed, or out of context. You should review Leon's behaviour during onboarding and adjust the configuration, scripts, and guardrails to suit your business.
We do not guarantee that Leon will book the right appointment every time, handle every edge case, or correctly understand every accent or background noise. For high-stakes interactions (legal, medical, payment disputes), you remain responsible for human review.
We continually improve the Service. Features may be added, changed, or removed. Material removals affecting a Subscription will be communicated reasonably in advance.
5. Subscriptions, fees, and trial
Subscriptions are billed monthly or annually in advance at the rates shown on our pricing page. The base subscription is banded by how many team members can take bookings, from £24/month, as shown on our pricing page.
New signups receive a 7-day free trial. We require a payment card at signup but do not charge it during the trial. On day 8, your card is charged for the band you selected. Trial behaviour and refund policy are described in full in our
Refund & Cancellation Policy.
Subscriptions may include usage-based components: an optional processing fee on payments you choose to run through Mekkan, priced by rail and by where the card was issued (in person via Tap to Pay on iPhone or Android: 1.9% + 20p on UK-issued cards, 2.9% + 20p on EEA-issued cards, 3.65% + 20p on cards issued elsewhere; Pay by Bank 0.8% + 20p; online deposits and pay links: 2.0% + 20p on UK-issued cards, 3.0% + 20p on EEA-issued cards, 3.75% + 20p on cards issued elsewhere), per-minute overage on the AI Receptionist and Talk to Leon add-ons, a 15% one-time commission (minimum £3) on brand-new customers acquired through the Mekkan client app, and a flat 10% commission on memberships sold via Mekkan. Direct bookings — walk-ins and owner/staff entries — are not charged. Usage-based components are billed at the end of each cycle for what you actually used.
All prices are exclusive of VAT, which we add at the applicable UK rate where required.
6. Platform role and payment routing
Mekkan is a technology platform. We provide the software that connects your studio with your end customers. We are not the merchant of record for transactions between your studio and your customers.
Card processing is handled by Stripe Payments UK, Ltd. and its affiliates ("Stripe"), a PCI-DSS Level 1 certified payment processor. Your use of payment features is also subject to the Stripe Connected Account Agreement and the Stripe Services Agreement. By accepting these Terms, you accept those agreements.
We never store full card numbers. Mekkan only sees a Stripe customer reference and metadata necessary to run the Service.
There are three distinct money flows on the Service, and our role differs for each:
- (a) Subscription fees you pay to Mekkan (your plan and any add-ons) — Mekkan is the merchant of record. Stripe processes the card on our behalf.
- (b) Marketplace bookings, where a brand-new customer discovers and books your studio through the Mekkan client app — your studio is the merchant of record for the service delivered to the customer. Mekkan facilitates the payment via Stripe Connect and deducts a 15% one-time platform commission (minimum £3) on that first booking only at settlement. Your studio receives the remainder via Stripe Connect payout.
- (c) Memberships sold via Stripe Connect — your studio is the merchant of record. The customer prepays; Stripe routes 90% of the gross to your Stripe Connect account immediately and 10% to Mekkan as platform commission. Mekkan does not hold customer funds at any point.
Refunds and disputes for studio-to-customer transactions (categories b and c above) are your responsibility as merchant of record. We make refund tooling available in your dashboard and via the Stripe Dashboard. Where Stripe refunds a transaction, our platform commission is refunded proportionally as described in the
Refund & Cancellation Policy.
You must comply with Stripe's prohibited business categories. We may suspend your account if your business model breaches Stripe's terms or relevant payments law (including UK PSR 2017, Money Laundering Regulations 2017, and FCA rules where applicable).
7. Acceptable use
You must not, and must not allow anyone to:
- use the Service for anything unlawful, fraudulent, or harmful to others;
- use Leon to make unsolicited marketing calls, spam, or any communications that breach the Privacy and Electronic Communications Regulations (PECR) or similar laws;
- attempt to reverse-engineer, decompile, or extract source code from the Service, except to the extent UK law expressly permits;
- use the Service to build a competing product, train a third-party AI model, or systematically scrape data;
- interfere with the Service's infrastructure, security, or other studios' use;
- upload content you do not have the right to share, or content that is defamatory, obscene, or infringing.
We may suspend or terminate your access if we reasonably believe you are breaching this section, especially where customer safety, legal compliance, or the integrity of the Service is at risk.
8. Your data, your customers' data
Studio Data belongs to you. You grant us a non-exclusive, worldwide licence to process Studio Data solely to operate, secure, support, and improve the Service for you and to comply with law.
For data about your Studio Customers, you are the data controller and we act as your processor under UK GDPR. The details of how we process personal data, sub-processors, retention, and your rights are set out in our
Privacy Policy.
We do not sell Studio Data. Our AI vendors do not train their general models on it.
On termination of your Subscription, you can export Studio Data for a reasonable period before we delete it in line with the Privacy Policy.
9. Our intellectual property
We own the Service, the Mekkan brand, Leon's name and persona, the dashboard interface, our underlying code, training datasets we have built, and all related intellectual property. Nothing in these Terms transfers ownership of any of that to you.
We grant you a non-exclusive, non-transferable right to use the Service while your Subscription is active and you comply with these Terms.
10. Third-party services
The Service depends on third parties (currently including Anthropic, ElevenLabs, Twilio, and our cloud provider). Your use of the Service is also subject to those parties' applicable terms where they govern the underlying service.
Outages, changes, or restrictions at third parties may affect the Service. We will make reasonable efforts to substitute or restore functionality but cannot guarantee uninterrupted operation of third-party-dependent features.
11. Termination and suspension
You may cancel your Subscription at any time from the dashboard. Cancellation takes effect at the end of your current billing cycle, as described in the Refund Policy.
We may suspend or terminate your access immediately if (a) you materially breach these Terms, (b) we are required to by law, (c) your payment is overdue and not cured within 7 days of notice, or (d) we reasonably believe continuing access risks fraud, abuse, or harm to other studios or end-users.
On termination, your right to use the Service ends. We will make Studio Data exportable for a reasonable period unless legally required to delete sooner.
12. Disclaimer
The Service is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the Service will be uninterrupted, error-free, secure against all attacks, or that Leon will produce correct outputs every time. AI is probabilistic; supervision matters.
13. Limitation of liability
Nothing in these Terms limits or excludes liability that cannot be limited or excluded under UK law, including for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation.
Subject to that, our total aggregate liability to you under or in connection with these Terms (whether in contract, tort, or otherwise) in any 12-month period is capped at the fees you actually paid us in the 12 months immediately preceding the event giving rise to the claim.
We are not liable for: (a) loss of profits, revenue, business opportunity, anticipated savings, or goodwill; (b) loss or corruption of data beyond our reasonable backup obligations; (c) indirect or consequential losses; or (d) third-party claims against you arising from your use of the Service or your handling of Studio Customers.
14. Your indemnity to us
You agree to indemnify and hold Mekkan harmless against any third-party claim arising from (a) your breach of these Terms, (b) your unlawful or negligent use of the Service, (c) your handling of Studio Customers, or (d) content or data you upload to the Service.
15. Force majeure
Neither party is liable for delay or failure to perform caused by events beyond reasonable control, including natural disasters, war, civil unrest, government action, sustained internet failure, or systemic third-party outages.
16. Changes to these Terms
We may update these Terms from time to time. For material changes — for example, changes that reduce your rights or increase your obligations — we will give you at least 30 days' notice by email or in the dashboard before the changes take effect.
Continuing to use the Service after the effective date of a change means you accept the updated Terms. If you do not accept, you can cancel under the Refund Policy.
17. Governing law and jurisdiction
These Terms are governed by the laws of England & Wales. You and we submit to the exclusive jurisdiction of the courts of England & Wales for any dispute arising out of or relating to these Terms, except that we may bring proceedings to protect our intellectual property in any competent jurisdiction.
Nothing in this section deprives a consumer of the protection of mandatory consumer-law rules of their place of habitual residence.
